Terms of Service

1. Introduction

Welcome to Aether Games, a platform that turns Twitch chat engagement - follows, subscriptions, gift subs, bits and donations - into interactive minigames shown on stream. These Terms of Service ("Terms") govern your use of the Aether Games website, dashboard, overlay and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service provides streamers with an OBS browser-source overlay, engagement-event detection, a points economy, leaderboards, guilds and optional chat announcements. The Service is operated as a multi-channel network: points earned in one channel can appear on shared and guild leaderboards, and bot chat messages are posted in your channel only when you enable them.

3. Accounts

You access the Service by signing in with your Twitch account. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and only operate accounts for channels you are authorised to represent. One streamer account may be associated with one channel at a time.

4. Free access and future subscription

The Service is currently provided free of charge. We may introduce a paid subscription tier in the future. If we do, existing features may move behind a subscription, and we will notify users with reasonable notice before any paid requirement takes effect. Nothing in these Terms obliges us to continue offering any feature free of charge.

5. Points, drops and virtual items

Points, multipliers, leaderboard positions, guild ranks and similar elements are virtual, non-monetary rewards. They have no real-world value, cannot be bought, sold, transferred or redeemed for money or goods, and may be adjusted, reset or removed by us at any time, including to correct errors, prevent abuse or maintain fair play.

6. Donations and bits

Donations, bits, subs and gift subs are processed by Twitch and third-party platforms, not by Aether Games. We do not handle payments and do not store payment information. Any points awarded in response to those events are virtual rewards governed by section 5 and do not represent a financial relationship between you and the Service.

7. Chat announcements

When enabled, the Service's chat bot may post short messages in your channel (for example, announcing a viewer's win). Messages are limited to the configured announcements. You are responsible for the bot's conduct in your channel and may disable announcements at any time from your dashboard.

8. Guilds

Guilds are user-created groups of streamers with shared leaderboards. Guild owners control membership, may transfer ownership, and may disband a guild. You join a guild voluntarily; we are not responsible for disputes between guild members or for the actions of guild owners.

9. Acceptable use

You agree not to: use the Service to spam, harass or deceive; attempt to manipulate points, leaderboards or drops through bots, fake events or abuse of test tools; impersonate others; interfere with the Service's operation; or use the Service in a way that violates Twitch's Terms of Service or applicable law. We may remove users or reset data for abuse without notice.

10. Intellectual property

The Service, including its software, overlay designs, branding and content, is owned by Aether Games or its licensors. You may use the Service for your streaming channel in accordance with these Terms but may not copy, resell or create derivative products from it without permission. Your channel name, display name and avatar remain yours, subject to the rights you grant us to display them on leaderboards and in announcements.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that overlay behaviour will match every stream setup.

12. Limitation of liability

To the maximum extent permitted by law, Aether Games shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim (or AUD 100 if you paid nothing).

13. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service, in whole or in part, at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination (sections 5, 10, 11, 12, 15) will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. You submit to the exclusive jurisdiction of the courts of New South Wales for any disputes relating to these Terms.
